Appeals Court Overturns Contraception Ruling

Law360 (March 16, 2007, 12:00 AM EDT) -- A federal appeals court has overturned a lower court ruling that said it was discriminatory for company health care plans to not cover contraception for women.

In a 2-1 decision Thursday, the U.S. Court of Appeals for the Eighth Circuit found that the policy of Union Pacific Railroad Company wasn’t discriminatory because it also doesn’t cover vasectomies and other contraceptive treatment for men. It also ruled that the U.S. Congress didn’t intend for birth control to be covered by such plans.
