State Farm Dodges Class Action Over Medicare

Law360, New York (November 5, 2010, 1:21 PM EDT) -- A federal judge has thrown out a putative class action alleging State Farm Mutual Automobile Insurance Co. failed to properly notify customers that their policies had fewer benefits because they recently enrolled in Medicare.

Judge John W. Sedwick of the U.S. District Court for the District of Alaska dismissed Velma Woods' lawsuit without prejudice Thursday. Judge Sedwick disagreed with State Farm that the suit was preempted by federal law, but then decided the complaint failed to meet federal pleading requirements.
