Chinese Exporter Steps Up Fight On Double Duty Claims

Law360, New York (November 5, 2010, 6:45 PM EDT) -- A Chinese exporter of refrigerator and oven racks is turning up the heat in its fight against countervailing and anti-dumping duties imposed on its products, arguing that the U.S. Department of Commerce has improperly refused to take action to avoid imposing double penalties on the exporter.

In a brief filed with the U.S. Court of International Trade on Friday, Guangdong Wireking Housewares & Hardware Co. Ltd. argued that U.S. anti-dumping laws do not block Commerce from taking actions to prevent double-counting of duties.
