9th Circ. Upholds USAID Win In Shipping Contract Suit

Law360, New York (November 5, 2010, 6:54 PM EDT) -- A federal appeals court ruled Friday that a U.S. shipping company's challenge to the government's way of awarding contracts under the Food for Peace program is moot, upholding a lower court's decision.

The government should be taken at its word when it says it has amended its policy to fit plaintiff American Cargo Transport Inc.'s demands, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit said.
