Federal Circuit: DMCA Does Not Cover Aftermarket Product

Law360, New York (September 1, 2004, 12:00 AM EDT) -- In a closely watched test of the Digital Millennium Copyright Act, the U.S. Court of Appeals for the Federal Circuit has upheld a lower court’s ruling that a garage-door opener designed as a replacement for a model made by a rival manufacturer does not violate the DMCA.

The appeals court agreed with a lower court’s ruling, which found that Chamberlain Group had failed to prove that a garage-door opener made by Skylink Technologies “enables either copyright infringement or a prohibited circumvention.”
