FirstEnergy Can't Shake $75M CERCLA Suit

Law360, New York (November 8, 2010, 5:14 PM EST) -- A magistrate judge has refused to trim most of the pollution liability claims brought by New York State Electric and Gas Corp. against FirstEnergy Corp. in a suit over cleanup costs at 18 upstate New York sites, dismissing claims against only one site and ruling that FirstEnergy could still be liable for pollution during periods it had tried to exclude.
