Court Finds Shell, Railroads Liable For Cleanup

Law360, New York (March 16, 2007, 12:00 AM EDT) -- An appeals court has determined that Shell Oil Co. and two railroads were responsible for footing the bill for the entire cleanup at a toxic waste site in California.

The U.S. Court of Appeals for the Ninth Circuit in San Francisco overturned a district court decision that Shell, Burlington Northern & Santa Fe Railway Co. and Union Pacific Transportation Co. were accountable for only a portion of the cleanup costs in the central valley town of Arvin near Bakersfield.
