Court Clears Butterball Depositions In Don, Doff Case

Law360, New York (November 9, 2010, 3:24 PM EST) -- A federal judge won't stop Butterball LLC from requesting discovery from 20 opt-in plaintiffs in a collective action over donning and doffing compensation.

Judge J. Leon Holmes of the U.S. District Court for the Eastern District of Arkansas on Friday rejected a bid from three former employees to stop Butterball from deposing two employees from each of the 10 departments at its Huntsville and Ozark, Ark., poultry processing plants. He agreed, however, to place a few restrictions on the company.
