Circuit Revives ERISA Suit Against Aetna

Law360 (March 19, 2007, 12:00 AM EDT) -- Aetna Life Insurance Co. did not have substantial evidence to deny disability benefits to a logistics specialist at The Boeing Co. who suffered from an arthritis-related condition, the Third Circuit ruled Friday.

The circuit court vacated a November 2005 ruling by the United States District Court for the Eastern District of Pennsylvania, which said that Aetna did not act arbitrarily and capriciously in terminating Thomas Steele's short term disability benefits. The circuit remanded the case back to the district court for proceedings consistent with its ruling....
