Tips For Employers To Avoid Suits Over Credit Checks

Law360, New York (December 8, 2010, 7:24 PM EST) -- The U.S. Equal Employment Opportunity Commission is currently seeking comment on a proposed credit report alternative, but it is unlikely to end up being adopted as a viable alternative for employers that want to use credit histories when making hiring decisions, attorneys say.

The EEOC's credit alternative would allow companies to ask a job candidate's former employer if the candidate had performed adequately, if there were any concerns about the worker's integrity or reliability, and if the ex-employer would rehire the worker.
