Judge Boots GNC Managers' FLSA Class Action

Law360, New York (November 12, 2010, 1:33 PM EST) -- A federal judge has thrown out a putative Fair Labor Standards Act collective action brought by employees of health products retailer GNC Corp. who claimed that the company forced them to work off the clock and shortchanged them on overtime pay.

The plaintiffs' allegations lacked enough detail to meet the pleading standards laid out the in U.S. Supreme Court's Iqbal and Twombly decisions, Judge William L. Standish of the U.S. District Court for the Western District of Pennsylvania said in a ruling issued Tuesday.
