Monro Can't Put Brakes On Service Fee Class Action

Law360, New York (November 11, 2010, 6:19 PM EST) -- Monro Muffler Brake Inc. has lost its bid to toss a putative class action accusing the automotive services company of unlawfully tacking on a 10 percent service charge to the advertised price of its work.

Judge Henry Edward Autrey of the U.S. District Court for the Eastern District of Missouri on Wednesday denied the defendant's motion to dismiss the suit, ruling that plaintiff John McCall had sufficiently stated a claim for deceptive business practices under the Missouri Merchandising Practices Act.
