Smith & Nephew Asks Court To Rethink FCA Ruling

Law360, New York (November 12, 2010, 1:13 PM EST) -- Smith & Nephew Inc. has asked a federal judge to reconsider a refusal to dismiss an ex-worker's False Claims Act suit claiming the U.K.-based medical device maker misrepresented the origin of products it sold to the U.S. government.

In a motion filed in the U.S. District Court for the Western District of Tennessee on Thursday, Smith & Nephew asked Judge Bernice Bouie Donald to reconsider the order, or alternatively to certify the decision for interlocutory appeal.
