5th Circ. Lifts Sanctions On Expert In FEMA Trailer MDL

Law360, New York (November 12, 2010, 1:35 PM EST) -- A federal appeals court has vacated a sanctions order against an expert witness for the plaintiffs in multidistrict litigation alleging they were issued formaldehyde-laden trailers by the Federal Emergency Management Agency after hurricanes Katrina and Rita.

The U.S. Court of Appeals for the Fifth Circuit on Thursday determined the lower court abused its discretion in sanctioning Mary DeVany for her testimony, allegedly exaggerating her role in the FEMA trailer MDL in an unrelated Washington state administrative court proceeding.
