Judge Orders 3rd Remand Of Taifa Hand Truck Duties

Law360, New York (November 15, 2010, 2:17 PM EST) -- Ruling that the U.S. Department of Commerce pulled evidence out of thin air to support a 384 percent anti-dumping duty on hand trucks made by China's Qingdao Taifa Group Co. Ltd., a judge has remanded the case to the agency for the third time.

Judge Jane A. Restani issued the order Friday in the U.S. Court of International Trade, telling the agency either to justify its contention that China's central government controls the company or to calculate a separate rate based on the evidence available....
