Judge Clears Path For Generic Dr. Reddy's Asthma Drug

Law360, New York (November 16, 2010, 2:15 PM EST) -- Indian drug maker Dr. Reddy's Laboratories Ltd. is in the clear to market a generic version of the asthma treatment Accolate after a federal judge ruled it did not infringe an AstraZeneca PLC patent.

On Monday, Judge Mary L. Cooper of the U.S. District Court for the District of New Jersey granted Dr. Reddy's motion for summary judgment of noninfringement, and she denied AstraZeneca's cross-motion for summary judgment on the issue of prosecution history estoppel.
