FDA Accused Of Contempt In Plan B Availability Case

Law360, New York (November 16, 2010, 6:43 PM EST) -- The Center for Reproductive Rights asked a federal judge Tuesday to find the U.S. Food and Drug Administration in contempt for failing to take any action on a petition to make Plan B birth control available without any restrictions over the counter.

The motion, filed in the U.S. District Court for the Eastern District of New York, argues that the agency has continued to let the petition languish despite a March 2009 order to reconsider its refusal of the petition.
