Court Reverses Part of Dr Pepper Race Case

Law360 (March 21, 2007, 12:00 AM EDT) -- An appeals court has reversed a lower court’s decision to dismiss a case alleging Dr Pepper didn’t promote an employee based on his race, saying the company didn’t prove there wasn’t a case to be made.

But in the Tuesday ruling, the U.S. Court of Appeals for the Fifth Circuit affirmed the dismissal of another portion of the case that alleged the beverage company fired the employee because he was black.
