Takeda Wins $16.8M In Fees For Misconduct

Law360, New York (March 21, 2007, 12:00 AM EDT) -- A U.S. federal judge has ordered two generic drug makers to pay $16.8 million in legal fees to Takeda Pharmaceutical Co Ltd. for their “exceptional misconduct and bad faith” during a patent challenge last year.

Judge Denise Cote ruled Wednesday that Mylan Laboratories Inc. pick up the greater portion of the tab and pay the Japanese drug company $11.4 million.

Alphapharm has been ordered to pay the remaining $5.4 million, with the total award accruing interest from September 2006 at a rate of 5.02%.
