Permanent Injunction Ends Topamax Patent Fight

Law360 (March 22, 2007, 12:00 AM EDT) -- A federal judge on Tuesday issued a final judgment in favor of Ortho-McNeil Pharmaceutical Inc. in the company’s patent infringement fight over a generic version of its blockbuster epilepsy drug.

After previously ruling that Mylan Laboratories Inc.’s generic version of Topamax infringed on Ortho-McNeil’s patent, Judge Stanley R. Chesler of the U.S. District Court for the District of New Jersey issued a permanent injunction against Mylan, effectively ending the longstanding dispute. The ruling also postponed the issuance of the generic drug until September 2008.
