Class Action Status Denied For Tritium Suit Plaintiffs

Law360, New York (March 22, 2007, 12:00 AM EDT) -- Illinois residents suing Exelon Corp. for radioactive tritium spills near Will County lost their plea to certify the lawsuit as a class action this week because their class was “overbroad.”

U.S. District Court Judge Suzanne Conlon said on Monday that the proposed class of plaintiffs, up to 6,500 people living in a 25-square-mile area surrounding Exelon’s Braidwood Generating Station, was too expansive.
