Delta Wins Dismissal Of Virgin Atlantic Seat IP Suit

Law360, New York (November 30, 2010, 3:52 PM EST) -- A U.K. court on Tuesday dismissed Virgin Atlantic Airways Ltd.'s claims that Delta Air Lines Inc. infringed a patent for first-class aircraft seats, but left the door open for Virgin to sue the Atlanta-based airline over related U.S. patents.

Judge Richard Arnold of the High Court of Justice, Chancery Division, Patents Court, granted summary judgment to Delta, finding Virgin had no prospect of establishing the airline had infringed the European patent for the Upper Class Suite seat.
