Workers Win Initial Cert. In Suit Against Tech Insurer

Law360, New York (November 30, 2010, 2:34 PM EST) -- A federal judge has granted conditional certification to a class in a wage-and-hour complaint alleging technology insurer Asurion Corp. failed to pay employees for time spent prepping and shutting down their workstations.

In an order Monday, Judge Aleta A. Trauger of the U.S. District Court for the Middle District of Tennessee said the plaintiffs met their “fairly lenient” burden for class certification, showing other employees share similar claims for violations of the Fair Labor Standards Act, but she also acknowledged weaknesses in their case.
