AmerescoSolutions Denied Quick Win In Contract Spat

Law360, New York (November 30, 2010, 1:38 PM EST) -- The Armed Services Board of Contract Appeals has rejected construction company AmerescoSolutions Inc.'s bid for summary judgment in its challenge of a decision by the U.S. Army Engineering Support Center to terminate for default a contract to renovate a military building in Alaska.

In a decision rendered Nov. 15 and made public Monday, the board ruled that AmerescoSolutions failed to show that the U.S. Army Corps of Engineers waived the completion deadline for the project after high asbestos levels were found in the building, requiring remediation....
