Mass. Bay Removes Home Repair Action To Fed. Court

Law360, New York (December 1, 2010, 1:54 PM EST) -- The Massachusetts Bay Insurance Co. has removed to federal court a putative class action from Arkansas homeowners who say the insurer should have covered the overhead costs of the contractors that fixed their homes.

The suit is eligible for removal under the Class Action Fairness Act because it meets minimum diversity requirements and may exceed $5 million in damages, Massachusetts Bay said in a removal notice lodged Tuesday in the U.S. District Court for the Western District of Arkansas.
