EBay Not Liable In L'Oreal Trademark Suit: EU Adviser

Law360, New York (December 9, 2010, 1:18 PM EST) -- An adviser to the European Union's highest court said Tuesday that eBay Inc. is generally not liable for unauthorized L'Oreal SA products sold through its website but that it could be held accountable if it fails to crack down on repeat infringers.

Niilo Jaaskinen, advocate general of the European Court of Justice, issued the opinion in response to L'Oreal's trademark challenge pending in the U.K. High Court, which ruled last year that the online auction site was not liable.
