6th Circ. Affirms Toss Of Blue Cross ERISA Action

Law360, New York (December 9, 2010, 12:30 PM EST) -- A federal appeals court has affirmed a lower court's decision to nix a putative class action against Blue Cross Blue Shield of Michigan, finding that the company was not acting as a fiduciary under the Employee Retirement Income Security Act when it negotiated a deal that resulted in higher rates for participants in its self-insured plans.
