US Doesn't Have To Pay For Failed Subcontract: Judge

Law360, New York (December 20, 2010, 2:08 PM EST) -- A federal judge has knocked down a breach of contract suit filed by a subcontractor seeking about $770,000 from the U.S. government after the prime contractor didn’t pay up on a Marine Corps project.

The government never had a contract with subcontractor YRC Inc., either express or implied, and the trucking company should look to prime contractor Salem Logistics Inc. for repayment, Judge Susan G. Braden of the U.S. Court of Federal Claims said in her summary judgment ruling for the U.S. on Thursday.
