ICP Disputes Fairness Of Forest Service Solicitations

Law360, New York (December 20, 2010, 3:00 PM EST) -- ICP Northwest LLC has launched a protest challenging the fairness and validity of the U.S. Forest Service's solicitations for certain “unique and technologically complex” equipment used by the agency in emergency response operations.

The government's proffered multiple regional and national bilateral preseason incident blanket purchase agreements for this technology are “invalid and unenforceable” because they are “based on promises from the awardees … made without binding promises from the U.S. Forest Service in return,” the contractor alleges in its complaint filed Friday in the U.S. Court...
