Dish Network Techs Denied Class Cert. In OT Action

Law360, New York (December 21, 2010, 7:24 PM EST) -- A federal judge has denied class certification to a group of satellite television dish technicians alleging Dish Network LLC's parent company failed to pay them properly for overtime.

While Judge William Zloch of the U.S. District Court for the Southern District of Florida acknowledged in an order Monday that the proposed class members held similar job descriptions and were subject to similar policies as named plaintiff Robert Shim, there were enough “significant individual considerations” to render a class action an unwieldy proposition, he said.
