Judge Nixes Mass. Hospital Workers' State Law Claims

Law360, New York (December 21, 2010, 2:15 PM EST) -- Revisiting an earlier ruling, a federal judge has decided to toss remaining state law claims in a putative wage-and-hour class action brought by workers against five Massachusetts hospitals.

On Monday, Judge F. Dennis Saylor IV of the U.S. District Court for the District of Massachusetts ruled in favor of defendants such as UMass Memorial Hospitals Inc. by dismissing five claims — including unjust enrichment and conversion — because the workers had to first pursue administrative remedies under a collective bargaining agreement.
