DC Circ. Tells NRC To Reconsider Honeywell Exemption

Law360, New York (December 22, 2010, 2:43 PM EST) -- A federal appeals court has ordered the Nuclear Regulatory Commission to revisit its decision not to exempt Honeywell International Inc. from a requirement that nuclear facility licensees have a tangible net worth at least 10 times its current decommissioning cost estimate.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit on Tuesday ruled that the NRC's denial of the exemption was inconsistent with its precedent regarding Honeywell’s exemption requests, and that its explanation for the denial was inadequate.
