8th Circ. To Let DOL Argue In Applebee's Tip Action

Law360, New York (December 22, 2010, 4:36 PM EST) -- A federal appeals court has given the U.S. Department of Labor the green light to argue on behalf of a class of Applebee's International Inc. workers in the restaurant chain's appeal of a lower court interpretation of the Fair Labor Standards Act's tip credit provision.

The U.S. Court of Appeals for the Eighth Circuit entered an order on Tuesday that granted the DOL's motion to participate in the arguments, and said the agency's attorneys could share the 20 allotted minutes of argument time with the Applebee's...
