10th Circ. Upholds Albuquerque City Workers' FLSA Loss

Law360, New York (January 13, 2011, 6:51 PM EST) -- The Tenth Circuit has upheld a lower court's ruling against a group of Albuquerque, N.M., city employees who wanted the overtime premiums spelled out in the Fair Labor Standards Act to be applied additionally to those in their employment contracts.

The FLSA is meant to set minimum standards, not top up negotiated employment deals, a three-judge panel of the U.S. Court of Appeals for the Tenth Circuit said Wednesday in a published opinion.
