Idaho Court Takes On E-Mail Privacy Case

Law360, New York (April 4, 2007, 12:00 AM EDT) -- The Idaho Supreme Court heard argument Tuesday in a case that will decide when e-mails sent by public employees are part of the public record and when they are not.

On one side is the Spokesman-Review newspaper of Spokane, Wash., which made a public records request in 2005 for all e-mail correspondence between Kootenai County Prosecutor William Douglas and a subordinate, Marina Kalani, who managed a now-defunct juvenile drug court.
