'Vogue' Belongs To Magazine, Not Shoe Shop: EU Court

Law360, New York (January 18, 2011, 6:41 PM EST) -- A European Union court sided Tuesday with Vogue publisher Advance Magazine Publishers Inc. against Europe's trademark registry, granting the company's appeal in a long-running case over the ownership of the trademark for the word "vogue" in Portugal.

Judge Irena Wiszniewska-Białecka of the General Court in Luxembourg reversed the 2003 judgment of the Office for Harmonization in the Internal Market, in which Advance Magazine Publishers lost the EU rights to the word "vogue" to a Portuguese footwear manufacturer.
