US Can't Shake ARRA Energy Suit Over $2.3M Grant

Law360, New York (January 20, 2011, 2:09 PM EST) -- A federal judge has given ARRA Energy Co. a boost in its fight for $2.3 million in renewable energy reimbursements from the U.S. government, finding that the government improperly denied the company's applications.

On Tuesday, Judge Lynn Bush of the U.S. Court of Federal Claims determined that section 1603 of the American Recovery and Reinvestment Tax Act is money-mandating, meaning that the U.S. Department of the Treasury lacked discretion to refuse ARRA’s request for federal grants.
