Setback For NASDAQ In Trademark Suit Over QQQ Trading

Law360, New York (September 20, 2004, 12:00 AM EDT) -- A federal judge has dismissed part of a trademark infringement lawsuit brought by Nasdaq Stock Market Inc. against Archipelago Holdings Inc. over Archipelago's trading of a highly liquid type of securities that Nasdaq claims as its intellectual property.

Wednesday's decision by the U.S. District Court for the Southern District of New York dismissed the part of Nasdaq's lawsuit that sought to stop Archipelago from trading a class of securities known as QQQ, but let litigation proceed over Archipelago's advertising of its QQQ business.
