Law360 (January 20, 2011, 5:04 PM EST) -- Virgin Atlantic Airways Ltd. has launched an infringement suit against rival Delta Airlines Inc. over a seating design patent, on the heels of its loss in another battle over the design in the U.K.
U.K.-based Virgin filed a lawsuit in the U.S. District Court for the District of Delaware on Tuesday claiming that Delta selected a sleeper suite seating system for its BusinessElite cabins that infringes on at least two of the patent's claims.
Virgin further alleges that Chicago-based aircraft manufacturer Boeing Co. imported the seating system into the U.S. for Delta and installed the seats in all Delta Boeing 777-232 and 777-232LR aircraft.
