Chemtura Faces False Marking Suit Over Insecticide
Law360 (January 21, 2011, 12:41 PM EST) -- Texas IP Research LLC has slapped Chemtura Corp. and Makhteshim Agan Industries Ltd. with a false patent marking suit over Rimon insecticide products.
Texas IP Research filed its complaint on Thursday in the U.S. District Court for the Eastern District of Texas, naming Chemtura, Israel-based Makhteshim Agan and two Makhteshim Agan subsidiaries as defendants.
The complaint claims that the defendants have marked, caused others to mark, or advertised Rimon 0.83EC insecticide products in combination with three expired patents. Defendant Makhteshim Chemical Works Ltd. makes the insecticide, while Chemtura markets it in the U.S.
