DC Circ. Says Calif. Airport Can't Ban Business Jets

Law360, New York (January 21, 2011, 5:51 PM EST) -- The D.C. Circuit has backed a Federal Aviation Administration decision that Santa Monica, Calif.'s plan to ban certain business jets at a city-owned airport violates the terms of a grant agreement with the agency.

In a precedential opinion issued Friday, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit denied Santa Monica’s petition for review and rejected its contention that, in overruling a law implementing the ban, the FAA ignored evidence and acted inconsistently with its own policies and prior rulings....
