Closing Co.'s Workers Didn't Choose To Leave: 9th Circ.

Law360, New York (January 21, 2011, 5:50 PM EST) -- The Ninth Circuit ruled Friday that a class of employees who left their jobs because the business was closing did not "voluntarily" depart from the company under the Worker Adjustment and Retraining Notification Act, reversing a lower court's decision. 

In a split ruling, the U.S. District Court for the Ninth Circuit overturned a lower court's judgment in favor of Gee West Seattle LLC in a WARN Act class action brought by the company's former employees.
