ABQ Fails To Quash Subpoena In BP Royalty Suit

Law360, New York (January 21, 2011, 7:00 PM EST) -- A federal judge has ordered nonparty ABQ Energy Group Ltd. to turn over subpoenaed documents in a class action accusing BP PLC's U.S. arm of breach of contract for withholding royalties on natural gas sales.

In an opinion issued Thursday, Magistrate Judge W. Daniel Schneider of the U.S. District Court for the District of New Mexico ruled that another magistrate judge wrongly found in August that ABQ's motion to quash the subpoena was untimely.
