9th Circ. Revives Macy's Copyright Suit Over Fabric

Law360, New York (January 26, 2011, 7:11 PM EST) -- The Ninth Circuit on Wednesday revived a fabric design copyright suit against Macy's Inc., ruling that a lower court ignored the presumption of copyright validity when it tossed the case.

The U.S. Court of Appeals for the Ninth Circuit reversed the U.S. District Court for the Central District of California's dismissal of United Fabrics International Inc.'s copyright suit for lack of standing.

The district court threw out the suit after concluding that United had failed to prove that it possessed a valid copyright for the designs....
