Japanese Co. Dealt Blow In EU Fight Over 'Fiorucci'

Law360 (January 27, 2011, 7:57 PM EST) -- The advocate general of the European Union's highest court recommended Thursday that the court reject Edwin Co. Ltd.'s challenge to a finding that Italian designer Elio Fiorucci was entitled to prevent third parties from registering his name as a trademark.

Advocate General Juliane Kokott of the European Court of Justice said the court should reject all four arguments of Japan-based Edwin's appeal on the grounds that the General Court had correctly applied Italian law in concluding that Edwin could not become the proprietor of the community...
