Lush Managers Win Class Cert. In Overtime Action

Law360, New York (February 1, 2011, 3:58 PM EST) -- A federal judge has agreed to conditionally certify a class of Lush Cosmetics LLC managers who claim the retailer illegally denied them overtime pay.

Notices of the collective action will begin going out to employees who worked for the five-state cosmetics chain in the last there years, Judge Charles Edwards Honeywell of the U.S. District Court for the Middle District of Florida ruled Friday.

The managers say Lush classed them as overtime-exempt under the Fair Labor Standards Act even though their main job was selling product...
