Judge Denies Class Cert., Tosses GM Apartheid Suit

Law360 (January 28, 2011, 7:27 PM EST) -- A federal bankruptcy judge Friday denied class certification and chucked claims in a lawsuit by a group of South African nationals who alleged that the old General Motors Corp. aided and abetted perpetrators of the apartheid system.

Judge Robert E. Gerber sided with the debtors' motion to disallow the claims from moving forward, either in class form or on an individual basis, after devoting the majority of the opinion to whether class certification was appropriate.
