Rodenticide Co. Triumphs In Bid To Challenge EPA Ban

Law360, New York (January 31, 2011, 4:36 PM EST) -- A federal judge has ruled that a producer of rodent-killing chemicals should have a chance to challenge a U.S. Environmental Protection Agency decision to ban one of the company's products.

Friday’s ruling by Judge Ellen S. Huvelle of the U.S. District Court for the District of Columbia bars the EPA from bringing any enforcement action against Reckitt Benckiser Inc. unless and until it has canceled EPA-sanctioned registrations Reckitt holds on the disputed products in accordance with Section 6 of the Federal Insecticide, Fungicide, and Rodenticide Act...
