US To Join FCA Action Against Abbott Over Depakote

Law360, New York (February 2, 2011, 5:18 PM EST) -- The U.S. has opted to intervene in a whistleblower suit brought by former Abbott Laboratories Inc. employees accusing the company and a subsidiary of an illegal scheme promoting off-label uses of the seizure drug Depakote that were reimbursed by the government.

The government filed its motion to intervene Tuesday in the U.S. District Court for the Western District of Virginia and also asked the court to unseal the qui tam action alleging Abbott and Abbott Pharmaceuticals PR Ltd. violated the False Claims Act.
