EPA Must Review Calif. Clean Air Plan: 9th Circ.

Law360, New York (February 2, 2011, 7:48 PM EST) -- The Ninth Circuit on Wednesday ruled that the U.S. Environmental Protection Agency must re-examine a California plan to improve air quality, which community and environmental groups say is insufficient to meet Clean Air Act standards in Los Angeles.

The U.S. Court of Appeals for the Ninth Circuit agreed with plaintiffs Association of Irritated Residents, El Comite Para el Bienestar de Earlimart, Community and Children's Advocates Against Pesticide Poisoning and the National Resources Defense Council Inc. that the EPA had failed in its duty to enforce air...
